EU CPNP, Announcement of regulatory revisions regarding CMR substances

On May 13, 2025, the EU announced an amendment to the European Council Regulation (EC) No 1223/2009 concerning the use of certain substances classified as carcinogenic, mutagenic, or toxic to reproduction (CMR) in cosmetic products.

 

Annex II of the regulation contains the list of prohibited substances, while Annexes III to VI include substances that are restricted or permitted under specific conditions.

 

The main points of this amendment are as follows:

1) Due to its classification as a CMR substance, Trimethylbenzoyl Diphenylphosphine Oxide (INCI) is no longer permitted for use in cosmetic products. Accordingly, entry 311 in Annex III of Regulation (EC) No 1223/2009 is deleted, and the substance is added to the list of prohibited substances in Annex II.

 

2) Cymoxanil (2-cyano-N-[(ethylamino)carbonyl]-2-(methoxyimino)acetamide) is already listed in Annex II of Regulation (EC) No 1223/2009. However, to align with Regulation (EU) No 2024/197, the entry is revised to include an additional chemical name ((2E)-2-cyano-N-[(ethylamino)carbonyl]-2-(methoxyimino)acetamide) and to correct the omission of relevant CAS number.

 

3) Additional substances classified as CMR are added to the list of prohibited substances in Annex II.

 

The regulation is scheduled to enter into force on June 2, 2025, and will apply from September 1, 2025.
