INDIA: NEW BATTERY WASTE RULES

To ensure environmentally safe and sound management of waste batteries, the Ministry of Environment, Forest and Climate Change has released a gazette notification, named "Battery Waste Management Rules, 2022". The new rules will replace the Batteries (Management and Handling) Rules, 2001.

 

Producers, dealers, consumers, and entities involved in collection, segregation, transportation, refurbishment, and recycling of waste batteries will fall under these rules.

 

The rules cover all types of batteries regardless of its chemistry, shape, volume, weight, material composition, and use, viz. electric vehicle batteries, portable batteries, automotive batteries, and industrial batteries.

 

An online centralized portal will soon be available for registration under the Battery Waste Management Rules, 2022. It will also enable a mechanism for the exchange of EPR certificates between producers and recyclers/refurbishes to fulfil the obligations of producers.

 

The new rules mandate a minimum percentage of material recovery from waste batteries and also prescribe the use of a certain number of recycled materials in the making of new batteries.

 

These battery rules will undoubtedly ensure the government of India's vision of promoting a circular economy in full force, wherein the EPR has been mandated for all the stakeholders.

 

Environmental Compensation shall be levied by the Central Pollution Control Board on producers operating with respect to non-fulfilment of their Extended Producer Responsibility targets, responsibilities, and obligations set forth in these rules.
