TEC has issued a clarification (file no. 6-6/2021-TC/TEC(Pt.II)) regarding MTCTE for replacement products of End of Life / End of Sale products under whole unit warranty.
According to the clarification, it is clarified that the models of the products of Phase III & IV under MTCTE, of which life or sale is declared to end before the mandatory certification date (July 01, 2023) by the manufacturer, are not covered under MTCTE regime.
Therefore, MTCTE is not required for the replacement products under whole unit warranty when End of Life / End of Sale of the product is declared to be before the effective date by the manufacturer.
To be exempted, the manufacturers are required to provide the list of such products to TEC as per required form, which has been declared as End-of-Life / End-of-Sale but replacement is still required under product warranty.
The form is available upon request.
