Thai FDA, Updates Guideline for Cosmetics Advertising

On September 24, 2024, the Thai FDA updated its cosmetics advertising guidelines to provide oversight and regulatory direction for cosmetics advertising management, in accordance with the 2015 Cosmetics Act.

 

The 2024 revised guidelines comprehensively cover topics related to cosmetics advertising, including the definition of cosmetics advertisements, relevant advertising laws, principles for cosmetics advertising, examples of various advertisement characteristics, and examples of advertising messages that may violate the law.

 

1. Definition of Cosmetics Advertising

- An activity intended to allow the public to see, hear, or recognize messages for commercial gain, considered as cosmetics advertising under the 2015 Cosmetics Act.

- Includes accurate and fact-based messages, as well as academic documents.

2. Cosmetic products must have correct labelling with a cosmetic registration number and comply with the following advertising regulations.

3. Advertising Regulations

- Verify that cosmetic advertising messages follow the principles of cosmetics advertising

- Ensure there are no advertising characteristics that violate legal provisions.

- Identify acceptable and unacceptable claims in cosmetics advertising messages based on product categories.

- (Example) 1. Skincare products containing whitening agents (whitening products)

Do (acceptable claims) Don’t (unacceptable claims)
- Terms like “whitening”, “lightening” and “brightening’ may be use in the text
- a message should be included to inform consumers that cosmetics cannot alter skin color.
- Advertisements referencing research or test results from specific institutions must clearly indicate that results may vary depending on individual conditions
- Statements implying results
- example: Claims suggesting that cosmetics can make the skin appear whiter or change its color.

 

- Advertising content must be truthful and verifiable, accurately conveying the product’s functions, characteristics, and performance.
